This Privacy Policy explains how MAD EXHAUSTS BV ("MAD Exhausts", "we", "us" or "our") collects, uses and shares personal data when you visit mad-exhaust.com, contact us, create an account, submit a review, subscribe to marketing or place an order.

1. Who is responsible for your data?

2. Personal data we collect

Depending on how you use our store, we may collect:

  • identity and contact data, such as your name, billing and delivery address, email address and telephone number;
  • order and transaction data, such as products ordered, order value, returns, warranty requests, payment status and delivery information;
  • payment-related data. Payment details are handled mainly by our payment providers; we generally receive confirmation, status and limited transaction information rather than full card details;
  • account, fitment and support data, including your motorcycle make, model, year and any information you include in a message, form or chat;
  • marketing and preference data, such as newsletter consent, cookie choices and communication preferences;
  • review and user-content data, such as ratings, review text, photos or other content you choose to submit;
  • technical and usage data, such as IP address, device and browser information, cookie or similar identifiers, pages and products viewed, search terms, referring URLs, cart events and interaction with our store and marketing.

We collect data directly from you, automatically from your device, and from service providers or sales channels involved in your visit or order.

3. Why we use personal data and our legal bases

  • To enter into and perform a contract: to show products, process and deliver orders, take payment, provide order updates, handle returns, warranty and fitment support, and manage customer accounts.
  • To comply with legal obligations: for tax, accounting, product-safety, fraud-prevention and other legal record-keeping requirements.
  • For our legitimate interests: to secure the store, prevent misuse and fraud, answer questions, improve products and the customer journey, measure store performance, maintain records and protect or establish legal claims. We balance these interests against your rights and expectations.
  • With your consent: for email or SMS marketing where consent is required, and for non-essential analytics, advertising and similar technologies where applicable. You can withdraw consent at any time without affecting earlier lawful processing.

If information is required to complete an order or provide requested support and you do not provide it, we may be unable to complete that service.

4. Cookies, pixels and similar technologies

Our store uses cookies, pixels, tags, local storage and similar technologies. Some are necessary for functions such as navigation, security, customer accounts, cart and checkout. Others help us understand store use, measure marketing, show relevant advertising, display reviews or media, and provide chat or forms.

Where consent is legally required, consent is the legal basis for non-essential analytics and advertising technologies. You can accept, reject or change available choices through the cookie controls provided on the store. You can also restrict cookies in your browser, although necessary store functions may then work less well.

The store currently uses or integrates services from Shopify, Google/YouTube, Meta (Facebook and Instagram), Mailchimp, Omnisend, Yotpo, Pop Convert, Gobot and Elfsight. These providers may receive technical and interaction data when their service is used or permitted. Further information is available in their own privacy notices.

5. Who receives personal data?

We share personal data only where reasonably necessary with categories of recipients such as:

  • Store platform and commerce services: Shopify, including Shop and Shop Pay where used. Shopify also provides security, analytics and checkout services. Shopify Network Intelligence is currently enabled for the store.
  • Payment providers: Shopify Payments and the payment method you choose, which may include PayPal, Klarna, Google Pay, iDEAL, banks and card networks.
  • Delivery and fulfilment providers: MyParcel and the relevant postal or parcel carrier.
  • Analytics and advertising providers: Google Analytics, Google Ads, Google/YouTube and Meta/Facebook/Instagram.
  • Marketing and on-site engagement providers: Mailchimp, Omnisend and Pop Convert.
  • Reviews, chat and website widgets: Yotpo, Gobot and Elfsight.
  • Business-support providers: IT, security, bookkeeping, professional advisers and authorities where required by law.

Some installed tools may process store or customer information only in the back office and may not be visible on every page. We require service providers to handle personal data for the agreed service and subject to applicable contractual and legal safeguards.

6. International transfers

Some providers operate from, or use service providers in, countries outside the European Economic Area. Where personal data is transferred internationally, we and our providers rely on an applicable lawful transfer mechanism, such as an adequacy decision, approved Standard Contractual Clauses or another safeguard permitted by data-protection law. You may contact us for more information about the safeguards relevant to your data.

7. How long we retain data

We retain personal data only for as long as necessary for the purpose for which it was collected, including customer service, warranty, security and legal-claim needs. Order, invoice and other records that form part of our tax administration are generally retained for seven years, or longer where another legal rule requires it. Marketing data is kept until you unsubscribe or we no longer need it, subject to a limited suppression record so we can respect your choice. Technical data and service-provider retention periods vary by tool and purpose.

8. Your rights

Subject to the conditions and exceptions in applicable law, you may ask us to:

  • provide access to your personal data;
  • correct inaccurate or incomplete data;
  • delete your data;
  • restrict or object to processing;
  • provide data you gave us in a portable format; or
  • withdraw consent at any time.

You can exercise these rights by emailing info@mad-exhausts.com. We may need to verify your identity before completing a request. You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens): autoriteitpersoonsgegevens.nl.

9. Marketing choices

We send electronic marketing only where permitted. You can unsubscribe using the link in a marketing message or by contacting us. Unsubscribing from marketing does not stop service messages about an order, warranty request or account.

10. Automated processing and fraud prevention

MAD Exhausts does not make decisions based solely on automated processing that produce legal or similarly significant effects for you. Shopify, payment providers and fraud-prevention services may use automated signals to assess transaction risk, secure the checkout or decide whether they can offer their own payment service. Where a provider acts as an independent controller, its privacy notice explains that processing and any relevant rights.

11. Children

Our store is not directed at children. We do not knowingly collect personal data from children. If you believe a child has provided personal data to us, please contact us so we can assess and, where appropriate, delete it.

12. Security

We use reasonable technical and organisational measures intended to protect personal data. No online service is completely secure, and we cannot guarantee absolute security.

13. Third-party links and embedded content

Our store may link to or embed third-party websites, videos, social content or services. Those third parties may process data under their own privacy notices. We encourage you to review those notices before using the relevant service.

14. Changes to this policy

We may update this policy when our store, services or legal obligations change. The date at the top shows the latest update. Material changes may also be communicated through the store or by another appropriate method.
